As we all know, in February this year many media reported that the Huawei sued Xiaomi, claiming that Xiaomi infringed four of Huawei's patents. These 4 patents have nothing to do with 5G, but include 2 4G/LTE patents and 2 patents for taking pictures and unlocking mobile phones.

However, there was no progress on this issue, with many believing that the two sides were negotiating or seeking reconciliation.

There are actually three general solutions to patent infringement: one is to prove that you are not infringed and everything will be fine. The second is that the two parties agree and agree to pay the other party's patent fees. The third, and still commonly used, is to declare the other party's patent invalid. If the other party's patent is invalid, then of course there will be no infringement.

For example, when the small iRobot in Shanghai sued Apple for infringing siri, Apple first sought to invalidate the other party's patent, then the two parties sued to invalidate the patent and, before the infringement proceedings were conducted, it was found to be valid.

Xiaomi hits back at Huawei

In the recent past some media reported that Xiaomi has also adopted the same trick of invalidating Huawei's patent. According to a statement from the State Intellectual Property Office, Xiaomi has recently initiated an invalidation request for Huawei's patent number "ZL201380073251.6".

This patent is one of the patents that Huawei has sued Xiaomi for infringing. This patent, which is supported by the majority of current smartphones, panoramic imaging, may be infringed and Xiaomi's request for it is therefore invalid.

Of course, no one knows what will happen in the end, but it is clear that Xiaomi has not objected to the other three patent infringements, i.e. it has admitted that it continues to use the other party's patents. It is estimated that the next step is to negotiate between the two parties and then to establish cooperation.

At the time of writing, Xiaomi officials have not yet reacted to the latest news.
