According to the "Notice of Acceptance of Administrative Rulings on Major Patent Infringement Disputes" published on page 2 of State Intellectual Property News , Huawei has sued Xiaomi for four patent infringement cases.

According to Silver Persimmon Finance, Xiaomi replied that the two parties are actively negotiating patent licensing. China's intellectual property rights protection system provides for a variety of settlement mechanisms, including administrative and judicial mediation. It is industry practice to resolve licensing issues through third party mediation mechanisms. Both Huawei and Xiaomi believe that IPR licensing and cooperation promotes innovation and public interest, and consider mediation to be an effective channel to facilitate the achievement of licensing. While they continue to actively negotiate, both parties will seek to use a wide range of mediation mechanisms to facilitate reaching an agreement.

On 17 January 2023, the National Intellectual Property Office accepted a case filed by the applicant Huawei against the defendant Xiaomi for infringement of four Chinese patents, according to the Notice of Administrative Decision on Major Patent Infringement Disputes. According to the contents disclosed in the case, the four patents involved in the litigation were "Method and device for sending control signal". The four patents in dispute are "Method and device for sending control signals", "Method for feeding back ACK/NACK information during carrier aggregation, base station and user device" and "Method and terminal device for extracting panoramic images", "Method for locking screen and mobile terminal". As regards the content of the patents, Cases 1 and 2 relate to 4G/LTE technology and are SEP standard basic patents. Cases 3 and 4 relate to the camera and unlocking technology of mobile phones and are not SEP patents.

Last year, at the opening of the 2022 World Design Capital conference, Huawei's CEO and Terminal BG CEO Yu Chengdong clashed over patent infringement. He said, "In many industries, especially some Chinese companies are copying our designs. Including some of our patents, people use them and don't pay us royalties, but use them directly and then talk about them as their own patents, and even copy some things directly."
